Developing the communication devices in the Kurdish community has created an opportunity for all to send their messages easily, using any media devices like (journals, magazines, radio, TV, social media and wireless instruments) to deal, connect and exchange the messages.

There is a significant responsibility as respecting those human rights that are accepted by the objective laws in Kurdistan Region. Neglecting and interference with the freedom of speech be a published crime as well.

In the article (19) of the Human Declaration of Rights from (1948) and section (2), article (19) of Covenant on Civil and Political Rights (1966) express the freedom of opinion through any media as global and basic rights of human beings.

Any country has its measure for democracy following its governing system; the best way to evaluate the democracy of that country is freedom of saying not slogans of power. Similarly, the Kurdistan Region has its law for media; it implements the freedom of expression in some fields while spreading several topics accepts as a crime. The journalists and media organizations should be known their boundaries to avoid crime.

The publishing crimes are printing and broadcasting a topic or a picture, it accepts as a public offense because the topic is a reason for making a crime. Also, such a crime is an infringement of the individual and communal rights as a result of abusing the opinion of speech.

In general, the principals broadcasting crimes are:

First, material principle, if any picture or topic has been distributed and breaks the rules call the material principle of crime. Any topic that hasn’t been broadcasted doesn’t take responsibility because and not belongs to the material principle of crime.

Second, moral principle Focuses on the mental and psychological sides of crime which means it depends on the extent of knowledge and his/her rationale are an essential base for appointing the category of the crime, however, unknowing is not an approvable justification for making a crime.

Third, legal principle concentrates on the law, no actions accept as a crime without law confirmation, for example, publishing a photo becomes a crime when violates a legal article or section.

Fourth, Principal of publishing, the journalists become criminal when a topic broadcasts on the media while sometimes the journalists have been hacked on the social media via the internet hackers, hence, the exact way is don’t save worthless photos or videos on your mobile and laptop because it is the only way to protect yourself from the hackers.
